The ED is facing this question in the Supreme Court of India
Why was Aam Aadmi Party (AAP) president and Delhi Chief Minister Arvind Kejriwal arrested just ahead of the Lok Sabha polls? The ED is facing this question in the Supreme Court of India.
The Supreme Court has asked a total of five questions to the Central Investigating Agency Enforcement Directorate (ED) in connection with Arvind Kejriwal’s arrest by the Supreme Court.
During the hearing of the case, a two-judge bench comprising Justice Sanjiv Khanna and Justice Dipankar Datta sought answers to these questions from the ED counsel and additional solicitor general of the country S V Raju.
Meanwhile, a two-judge bench, referring to S V Raju, said you cannot deny that life and liberty are of utmost importance. It has also sought answers to a question on how Kejriwal is involved in delhi’s liquor policy scandals and illegal financial transactions.
The next hearing in the case will be held on Friday. Meanwhile, the ED will have to answer five questions to the court.
Earlier on Monday, while hearing Kejriwal’s plea, the Supreme Court had asked Arvind Kejriwal’s counsel why you have not filed an application in the trial court.
In this regard, Kejriwal’s lawyer Abhishek Manu Singhvi said there are many reasons for this, one of which is that Kejriwal’s arrest is illegal.
Chief Minister Arvind Kejriwal filed a petition in the Supreme Court saying his arrest was illegal and his detention was also illegal. This is part of politics ahead of the general elections in the country.
In his plea, Kejriwal said it was an attempt to finish off a political party. During the hearing on Monday, Abhishek Manu Singhvi told the court that anyone can be arrested only if evidence of guilt is found and not just on the basis of suspicion.
After this, the court asked why Kejriwal did not appear for questioning despite repeated summons. What is the remedy for the investigating officers in such a situation?
In this question, Singhvi said that non-recording of statements is not the basis for arrest. When the ED can come to the chief minister’s residence for arrest, why can’t he come to record his statement?
