After the approval of the three bills passed by the Parliament by the President of India, Bharatiya Sakshya Adhiniyam 2023, Bharatiya Nagarik Suraksha Sanhita 2023 and Bharatiya Nyaya Sanhita 2023 to come into effect from 1st July, 2024.
With this, the past will become the IPC or the Indian Penal Code. The Union Home Ministry issued three notifications in this regard on Friday, February 23.
It may be recalled that the ruling BJP government at the Centre has replaced the three new laws in circulation in India. With the implementation of these three new laws, India will abolish the Indian Penal Code (Indian Penal Code), The Criminal Code (Code of Criminal Procedure) and the Indian Evidence Act (Indian Evidence Act).
According to the new criminal law, from now on, if a minor rapist and a gang-person is killed in an attack, the punishment for such an offence will be the death penalty. The trial court will have to conclude the trial in any case in three years and deliver its final verdict within 40 days.
According to the new law, if an accused is not produced before the court within 90 days, the trial will begin in the absence of such accused. Those convicted will get a chance to apply for innocence within seven days of the pronouncement of the verdict.
Under this new law, women can file cases from home. However, the police have to reach the spot within 24 hours. The case must be registered within 3 days of filing the complaint.
The driver who ran away after being hit by a car can be 10 years old and the driver’s punishment for taking those injured to the hospital after being hit by a car could be half. Similarly, even if the offender pleads guilty in 30 days, the punishment will be half.
Even if a person is beaten on the head, the punishment will be 10 years. This new criminal law also mentions the punishment for terrorism. The definition of terrorism is defined here. Accordingly, if any person endangers the integrity and security of the country, it will be terrorism.
The criminal law against the country will replace the prevailing sedition law. The new law will severely punish crimes against women, children, human rights, border protection and the army.
It may be recalled that all the three bills were passed in the Lok Sabha and Rajya Sabha amid a contentious situation. All the three bills were passed in the almost opposition empty house after the opposition in parliament suspended 143 MPs each due to the uproar by the opposition in Parliament in the Prime Minister’s statement on the security, security of the House and the bomb attack in the Lok Sabha.
