India is the largest country with the world’s population, beating China. India’s population does not grow but explodes. Rule 24(4) of the Rajasthan Police Subordinate Services Rules, 1989 is non-discriminatory and does not violate the Constitution, the bench said. The Rajasthan rule stated that no candidate with more than two children on or after June 1, 2002 would be eligible for appointment to government services.

The victim Ramjilal argued that apart from the rules that determine the eligibility criteria of two children, there are also rules for appointing ex-army personnel. The rules for the appointment of ex-army personnel do not mention the condition of not having more than two children.
